Notes on data protection and guarantee

You are already registered as a user on the RIO platform of TB Digital Services GmbH (Oskar-Schlemmer-Str. 19-21, 80807 Munich, Germany; hereinafter referred to as "TBDS") and wish to import or transfer data from your Idem telematics solution (Lazarettstraße 4, 80636 Munich, Germany) (hereinafter collectively referred to as "Idem") into your RIO commercial vehicle fleet and thus your RIO platform user account by activation of data sharing in the Kögel Telematics Portal.

1. Purposes of data processing
   For this purpose, by confirming this Privacy Policy in addition to Item 8.3 of the General Terms and Conditions for RIO Platform Use (the "Platform Terms and Conditions") and the RIO Order Processing Agreement pursuant to Article 28 GDPR, you agree to
   1. TBDS transmitting your personal data listed in Section 2 to Idem for the purpose of registering your commercial vehicle(s) in your RIO platform user account and to Idem processing such personal data for the specified purpose; and
   2. Idem transmitting your personal data listed under Section 2 and stored by it to TBDS on a recurring basis and to TBDS further processing this data for the purpose of providing RIO services and/or RIO third-party services to you as a user of the RIO platform.
2. Which data will be transferred?
   1. For the purpose of adding your commercial vehicle(s) to your RIO platform user account, the following data will be transmitted from TBDS to Idem:
      • the integration ID of the connection between the RIO platform and Idem and
      • your account ID
   2. After successful registration of your commercial vehicle(s) in your RIO platform user account [see Item (1)], the following data will be transmitted by Idem to TBDS on a recurring basis:
      • the master data of your commercial vehicle, i.e. vehicle identification number (VIN), vehicle production data, vehicle make, vehicle type, vehicle configuration, fuel type as well as exhaust class;
      • the usage data of your commercial vehicle, i.e. position data, mileage, speed, engine operating hours, weight and vehicle usage analysis data; and
      • the number of the driver card used in your commercial vehicle.
3. Legal basis for data processing
   The (data) processing activities described above have the following legal bases:
   1. your consent to one or more specific purposes described in this Privacy Policy pursuant to Article 6(1a) GDPR;
   2. fulfilment of a contract or implementation of pre-contractual measures as per Article 6(1b) GDPR.
4. Your rights
   You have the right to be informed about the data relating to you, and – if technically possible – the right to have your data corrected. Provided that there are no statutory regulations to the contrary, you also have the right to have your data erased and the right to restrict the processing of data collected about you for the above-mentioned purposes. Furthermore, you have the right to data portability.
   
   You further have the right to revoke this consent. Your consent is voluntary and valid until revoked. Any revocation by you shall not affect the legality of the collection, processing and transmission of data based on your consent before you revoked it.

However, if you withdraw your consent, we draw your attention to the fact that we will no longer be able to provide you with the data relating to your commercial vehicle(s) listed under Section 2 in your RIO platform user account and will be obliged to stop transmitting data from your Idem telematics solution to TBDS.
