Notes on data protection and guarantee
You are already registered as a user on the RIO platform of TB Digital Services GmbH (Oskar-Schlemmer-Str. 19–21, 80807 Munich; hereinafter “TBDS” and would like to use the Timed service by booking the service in the RIO marketplace.
- Purposes of data processing
For this purpose, by confirming this Privacy Policy in addition to Item 8.3 of the General Terms and Conditions for RIO Platform Use (the "Platform Terms and Conditions") and the RIO Order Processing Agreement pursuant to Article 28 GDPR, you agree that- TBDS will process the personal data listed under Section 2 from you (a) for the purpose of providing the Timed service to you as a user of the RIO platform and (b) for the purpose of calculating working, driving and rest times in accordance with Directive 2002/15/EC, Regulation (EC) No. 561/2006 and Regulation (EU) No. 165/2014, will provide this information recurringly to DAKO GmbH (Brussels Str. 22, 07747 Jena; hereinafter referred to as DAKO GmbH; and
- DAKO GmbH may process the personal data listed under Section 2 on behalf of TBDS for the purpose of calculating a driver’s working, driving and rest times in accordance with Directive 2002/15/EC, Regulation (EC) No. 561/2006 and Regulation (EU) No. 165/2014 and may transmit it to TBDS on a recurring basis.
- Which data will be transferred?
For the purpose of providing the RIO Timed service and calculating working, driving and rest times, the following personal data is transmitted from you to DAKO GmbH at regular intervals:
Your RIO user name and your company name stored with us;
the vehicle identification number (VIN) of your commercial vehicle;
the number of the driver card used in your commercial vehicle; and
the driver identification number along with the driver’s name and date of birth.
- For the purpose of calculating working, driving and rest times in accordance with Directive 2002/15/EC, Regulation (EC) No. 561/2006 and Regulation (EU) No. 165/2014, the following personal data is processed by DAKO GmbH and then repeatedly transmitted to TBDS:
Your RIO user name and your company name stored with us;
the vehicle identification number (VIN) of your commercial vehicle;
the number of the driver card used in your commercial vehicle; and
the driver identification number along with the driver’s name and date of birth.
- Legal basis for data processing
The (data) processing tasks described above have the following legal basis:
your consent to one or more specific purposes described in this Privacy Policy pursuant to Article 6(1a) GDPR;
fulfilment of a contract or implementation of pre-contractual measures as per Article 6(1b) GDPR.
- Your rights
You have the right to be informed about the data relating to you, and – if technically possible – the right to have your data corrected. Provided that there are no statutory regulations to the contrary, you also have the right to have your data erased and the right to restrict the processing of data collected about you for the above-mentioned purposes. Furthermore, you have the right to data portability.
You further have the right to revoke this consent. Your consent is voluntary and valid until revoked. Any revocation by you shall not affect the legality of the collection, processing and transmission of data based on your consent before you revoked it.

If you withdraw your consent to the data processing and data transfer described in Section 1, we would like to point out that we will no longer be able to provide the RIO Timed service and that TBDS is entitled to terminate the service.
